Registration of the purchaser\u2019s ownership rights\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">is possible only if the property owner has given written consent to transfer\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">ownership to the purchaser. This is done either in the text of the contract\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">itself or in a separate document, known as a\u00a0<\/span><span style=\"font-size: 1rem;\">\u00ab<\/span><span style=\"font-style: inherit; font-weight: inherit;\">\u201cpermission\u201d<\/span>\u00bb<span style=\"font-style: inherit; font-weight: inherit;\">\u00a0for registration. If this document is missing,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">the buyer\u2019s application for registration of ownership will be denied.\u00a0<\/span><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">\u00a0<\/span><\/p><p><span style=\"font-style: inherit;\"><b>Purchase Permit for Foreign Citizens<\/b><\/span><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">A foreign citizen is entitled to purchase\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">Hungarian real estate provided they have a permit from the county administration;\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">a purchase agreement alone is not sufficient.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">Currently, permits are issued to virtually everyone without exception; compliance with the formal requirements is sufficient:\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">a purchase agreement, payment of a fee of 65,000 HUF, and submission of a notarized copy of the foreign passport.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">By law, the processing time for the permit is 45 days; in practice,  it can take up to two months.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">\u0434\u043e\u0441\u0442\u0438\u0433\u0430\u0442\u044c 2-\u0445 \u043c\u0435\u0441\u044f\u0446\u0435\u0432.<\/span><\/p><p>\u00a0<\/p><p><b>State fee<\/b><\/p><p>The buyer of real estate pays a one-time fee to the state budget equal to\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">4% of the property\u2019s value as stated in the contract.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">The fee is paid in accordance with a decision issued by the tax office,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">which is sent directly to the buyer or their attorney, typically several months\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">after the buyer\u2019s ownership rights have been registered in the real estate registry.<\/span><\/p><p>\u00a0<\/p><p><b>Income Tax<\/b><\/p><p>Income from the sale of real estate is taxed at a rate\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">of 15% of the difference between the purchase price and the sale price of the property.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">The tax amount is reduced in proportion to the length of time the property has been owned.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">If the property is sold after being owned for 5 years,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">the income from the sale is not subject to tax.\u00a0<\/span><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">\u00a0<\/span><\/p><p><span style=\"font-style: inherit;\"><b>Title Deed<\/b><\/span><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">The document that officially certifies property details\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">(address, area, category, ownership information, encumbrances, etc.) is known as the property certificate.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">Any person can obtain a property certificate at any regional branch of the real estate registry;\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">all that is required is to know the property\u2019s address and cadastral number and pay the fee.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">After the contract is signed but before it is executed, the property title deed indicates\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">that the real estate sale and purchase procedure has begun,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">which prevents abuses such as the resale of the property or the registration\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">of a mortgage or other encumbrances on the property.<\/span><\/p><p>\u00a0<\/p><p><b>Mortgage Registration<\/b><\/p><p>To secure obligations arising from civil law contracts, such as a loan agreement,\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">the parties must enter into a mortgage agreement in addition to the loan agreement.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">Based on these two agreements, a mortgage right in favor of the lender\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">lender is registered in the real estate registry.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">In the event of a breach of contractual obligations, the lender is entitled to exercise the mortgage right and seek,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">through the courts, the auction sale of the real estate, followed by the recovery\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">of the amount owed to the lender from the proceeds of the auction sale.<\/span><\/p><p>\u00a0<\/p><p><b>Power of Attorney<\/b><\/p><p>If the buyer or seller is unable to be present in person\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">at the signing of the contract, they may authorize another person to sign the contract on their behalf;\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">this authorization must be certified by a lawyer or notary.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">If the signing takes place outside Hungary, it must be certified\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">by the consular section of the Embassy of the Republic of
