A vev\u0151 tulajdonjog\u00e1nak bejegyz\u00e9se csak akkor lehets\u00e9ges, ha\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">az ingatlan tulajdonosa \u00edr\u00e1sban hozz\u00e1j\u00e1rult a tulajdonjog\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">\u00e1truh\u00e1z\u00e1s\u00e1hoz a vev\u0151 r\u00e9sz\u00e9re. Ez t\u00f6rt\u00e9nhet ak\u00e1r mag\u00e1ban a szerz\u0151d\u00e9s sz\u00f6veg\u00e9ben, ak\u00e1r\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">egy k\u00fcl\u00f6n dokumentumban, az \u00fagynevezett bejegyz\u00e9si\u00a0<\/span><span style=\"font-size: 1rem;\">\u00ab<\/span><span style=\"font-style: inherit; font-weight: inherit;\">\u201eenged\u00e9lyben\u201d.<\/span>\u00bb<span style=\"font-style: inherit; font-weight: inherit;\">\u00a0Ha ez a dokumentum hi\u00e1nyzik,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">a vev\u0151 tulajdonjog\u00e1nak bejegyz\u00e9s\u00e9t elutas\u00edtj\u00e1k.\u00a0<\/span><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">\u00a0<\/span><\/p><p><span style=\"font-style: inherit;\"><b>V\u00e1s\u00e1rl\u00e1si enged\u00e9ly k\u00fclf\u00f6ldi \u00e1llampolg\u00e1rok sz\u00e1m\u00e1ra<\/b><\/span><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">A k\u00fclf\u00f6ldi \u00e1llampolg\u00e1r\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">a megyei k\u00f6zigazgat\u00e1si hat\u00f3s\u00e1g enged\u00e9ly\u00e9vel jogosult magyar ingatlant v\u00e1s\u00e1rolni;\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">ehhez a szerz\u0151d\u00e9s \u00f6nmag\u00e1ban nem elegend\u0151. Jelenleg az enged\u00e9lyt gyakorlatilag kiv\u00e9tel n\u00e9lk\u00fcl mindenkinek kiadj\u00e1k,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">elegend\u0151 a formai felt\u00e9telek teljes\u00edt\u00e9se: a szerz\u0151d\u00e9s megl\u00e9te,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">a 65 000 forint \u00f6sszeg\u0171 illet\u00e9k befizet\u00e9se, valamint a k\u00fclf\u00f6ldi \u00fatlev\u00e9l k\u00f6zjegyz\u0151 \u00e1ltal hiteles\u00edtett m\u00e1solat\u00e1nak csatol\u00e1sa.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">A t\u00f6rv\u00e9ny szerint az enged\u00e9ly kiad\u00e1s\u00e1nak hat\u00e1rideje 45 nap, a gyakorlatban azonban\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">ez ak\u00e1r 2 h\u00f3napig is eltarthat.<\/span><\/p><p>\u00a0<\/p><p><b>K\u00f6zigazgat\u00e1si illet\u00e9k<\/b><\/p><p>Az ingatlanv\u00e1s\u00e1rl\u00f3 egyszeri illet\u00e9ket fizet az \u00e1llami k\u00f6lts\u00e9gvet\u00e9sbe, amelynek m\u00e9rt\u00e9ke\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">a szerz\u0151d\u00e9sben szerepl\u0151 ingatlan\u00e9rt\u00e9k 4%-a. Az illet\u00e9k befizet\u00e9s\u00e9re az ad\u00f3hat\u00f3s\u00e1g hat\u00e1rozata alapj\u00e1n ker\u00fcl sor,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">amelyet k\u00f6zvetlen\u00fcl a jogszerz\u0151nek vagy az \u00fcgyv\u00e9dnek k\u00fcldenek meg,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">\u00e1ltal\u00e1ban n\u00e9h\u00e1ny h\u00f3nappal azut\u00e1n, hogy a jogszerz\u0151 tulajdonjog\u00e1t\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">bejegyezt\u00e9k az ingatlan-nyilv\u00e1ntart\u00e1sba.<\/span><\/p><p>\u00a0<\/p><p><b>J\u00f6vedelemad\u00f3<\/b><\/p><p>Az ingatlan elad\u00e1s\u00e1b\u00f3l sz\u00e1rmaz\u00f3 j\u00f6vedelem az ingatlan v\u00e9tel\u00e1r\u00e1nak \u00e9s elad\u00e1si \u00e1r\u00e1nak\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">k\u00fcl\u00f6nbs\u00e9g\u00e9nek 15%-\u00e1t kitev\u0151 ad\u00f3 al\u00e1 esik.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">Az ad\u00f3 m\u00e9rt\u00e9ke ar\u00e1nyosan cs\u00f6kken az ingatlan tulajdonban tart\u00e1s\u00e1nak id\u0151tartam\u00e1val.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">Ha az ingatlant 5 \u00e9vn\u00e9l hosszabb tulajdonban tart\u00e1s ut\u00e1n \u00e9rt\u00e9kes\u00edtik,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">az ingatlan elad\u00e1s\u00e1b\u00f3l sz\u00e1rmaz\u00f3 j\u00f6vedelem ad\u00f3mentes.\u00a0<\/span><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">\u00a0<\/span><\/p><p><span style=\"font-style: inherit;\"><b>Tulajdonjogi okirat<\/b><\/span><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">Az ingatlan adatait\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">(c\u00edm, alapter\u00fclet, kateg\u00f3ria, tulajdonjogi adatok, terhek stb.) hivatalosan igazol\u00f3 dokumentum az \u00fagynevezett tulajdonlap.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">A tulajdonlapot b\u00e1rki beszerezheti az ingatlan-nyilv\u00e1ntart\u00e1s b\u00e1rmely ker\u00fcleti irod\u00e1j\u00e1ban;\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">ehhez csup\u00e1n az ingatlan c\u00edm\u00e9t \u00e9s kataszteri sz\u00e1m\u00e1t kell tudni, valamint meg kell fizetni a d\u00edjat.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">A szerz\u0151d\u00e9s al\u00e1\u00edr\u00e1s\u00e1t k\u00f6vet\u0151en, annak teljes\u00edt\u00e9s\u00e9ig a tulajdonlapban felt\u00fcntetik\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">az ingatlan ad\u00e1sv\u00e9teli elj\u00e1r\u00e1s megkezd\u00e9s\u00e9t,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">ami megakad\u00e1lyozza a vissza\u00e9l\u00e9seket, p\u00e9ld\u00e1ul az ingatlan ism\u00e9telt elad\u00e1s\u00e1t\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">vagy az ingatlanra vonatkoz\u00f3 jelz\u00e1log vagy egy\u00e9b terhek bejegyz\u00e9s\u00e9t.<\/span><\/p><p>\u00a0<\/p><p><b>Jelz\u00e1log bejegyz\u00e9se<\/b><\/p><p>A polg\u00e1ri jogi szerz\u0151d\u00e9sekb\u0151l, p\u00e9ld\u00e1ul a k\u00f6lcs\u00f6nszerz\u0151d\u00e9sb\u0151l ered\u0151 k\u00f6telezetts\u00e9gek\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">biztos\u00edt\u00e9kak\u00e9nt a feleknek a k\u00f6lcs\u00f6nszerz\u0151d\u00e9s mellett jelz\u00e1logszerz\u0151d\u00e9st is kell k\u00f6tni\u00fck.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">E k\u00e9t szerz\u0151d\u00e9s alapj\u00e1n a jelz\u00e1logjogot a hitelez\u0151 jav\u00e1ra\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">bejegyzik az ingatlan-nyilv\u00e1ntart\u00e1sba.\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">A szerz\u0151d\u00e9ses k\u00f6telezetts\u00e9gek nemteljes\u00edt\u00e9se eset\u00e9n a hitelez\u0151 jogosult a jelz\u00e1logjogot \u00e9rv\u00e9nyes\u00edteni,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">\u00e9s b\u00edr\u00f3s\u00e1g \u00fatj\u00e1n k\u00e9rni az ingatlan \u00e1rver\u00e9sen t\u00f6rt\u00e9n\u0151 elad\u00e1s\u00e1t,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">majd az ingatlan \u00e1rver\u00e9sen t\u00f6rt\u00e9n\u0151 elad\u00e1s\u00e1b\u00f3l sz\u00e1rmaz\u00f3 \u00f6sszegb\u0151l a neki j\u00e1r\u00f3 \u00f6sszeget behajtani.<\/span><\/p><p>\u00a0<\/p><p><b>Meghatalmaz\u00e1s<\/b><\/p><p>Amennyiben a vev\u0151 vagy az elad\u00f3 nem tud szem\u00e9lyesen jelen lenni\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">a szerz\u0151d\u00e9s al\u00e1\u00edr\u00e1sakor, meghatalmazhat egy m\u00e1sik szem\u00e9lyt a szerz\u0151d\u00e9s al\u00e1\u00edr\u00e1s\u00e1ra;\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">a meghatalmaz\u00e1st \u00fcgyv\u00e9dnek vagy k\u00f6zjegyz\u0151nek kell hiteles\u00edtenie;\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">ha Magyarorsz\u00e1gon k\u00edv\u00fcl t\u00f6rt\u00e9nik, akkor ezt a Magyar K\u00f6zt\u00e1rsas\u00e1g Nagyk\u00f6vets\u00e9g\u00e9nek\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">konzuli oszt\u00e1ly\u00e1n kell
